The British Government has asked the tribunal to assess the petition of the UN Committee on Rights of Persons with Disabilities (CDPD) mantener los mechanisms de respiration y alimentación asistida mientras evalúa su caso.
According to The Guardian, Edward Devereux QC, representing the fathers of Archie, argued that the tribunal “had no discretion” to ignore the CDPD, because doing so “would be a flagrant and unacceptable violation of international law”. Sin embargo, Fiona Paterson, de los fideicomisos del NHS de Bart, dijo que no sería una violation del derecho internacional because the relevant treaty was not incorporated into the national law through legislation.
Los jueces expressed their concern for the time that the CPRD could take to consider the case, and one observed that it generally meets only twice a year. Devereux solicited the tribunal to grant a suspension to allow the CPRD to consider Archie’s case or, given the uncertainty about how much time it would take, to grant a one-week suspension to seek information from the committee on the probable time frame for its decision.

Archie’s mother said that doctors and judges should not have the last word on Archie’s treatment.
The case is the last one in the United Kingdom that has faced the judgment of doctors against the wishes of families. In various cases, including this one, the families have been supported by a group of religious pressure, Christian Concern.
According to British law, it is common for the courts to intervene when parents and doctors do not agree with the treatment of a child.
Alistair Chesser, medical director of Barts Health NHS Trust, which administers the hospital, said that “the plan to withdraw the treatment will continue unless the tribunal indicates otherwise”.
“Our deepest condolences are with Archie’s family in this difficult time”he said.
